ComplianceWorxs provides the Inspection Reconstruction Review as an educational and self-evaluative tool. ComplianceWorxs is not responsible for, and disclaims liability for, any regulatory outcome, inspection finding, audit determination, observation, citation, or enforcement action that may result from or be related to the records, processes, or decisions evaluated using the review.

User responsibility

You acknowledge that the observation produced by the review reflects only the answers you provide and that ComplianceWorxs is not in a position to independently verify those answers or to evaluate the actual state of your records, processes, or organization. You are solely responsible for the regulatory decisions made within your organization, the records that document those decisions, and the inspection readiness of those records.

Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless ComplianceWorxs, its officers, employees, and contractors from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Inspection Reconstruction Review; (b) any regulatory action, inspection finding, or enforcement matter involving your organization; (c) any representation made by you to a third party based on the observation produced by the review; or (d) your breach of the Terms of Service.

Limitation of liability

To the maximum extent permitted by law, ComplianceWorxs's total liability arising from or related to the Inspection Reconstruction Review shall not exceed one hundred dollars ($100). ComplianceWorxs shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including without limitation lost profits, lost data, business interruption, or regulatory enforcement costs.

Governing law

This statement is governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws provisions.
